Application for a Sexual Entertainment Venue Licence and a Sex Shop and Sex Cinema Licence To consider an application made by Leisure and Lifestyle Events Ltd, The Gables, Llangathen, Carmarthenshire, SA32 8QD for a Sexual Entertainment Venue (SEV), Sex Shop and Sex Cinema licence, under the Local Government (Miscellaneous Provisions) Act 1982. Minutes: Members were invited to consider an application made by Mr Ross of Leisure and Lifestyle Events Ltd., The Gables, Llangathen, Carmarthenshire, SA32 8QD for a Sexual Entertainment Venue (SEV), Sex Shop and Sex Cinema licence, under the Local Government (Miscellaneous Provisions) Act 1982. The Council’s Regulatory Services Officer presented the report and explained that the objector had intimated they wished to be present but had not arrived. West Midlands Police had enquired about safety measures to prevent under age persons being in attendance and were satisfied by Mr Ross (applicant) that the event would be managed professionally. A conference call to Mr Ross allowed Members the opportunity to question him regarding his experiences of running similar events and his expectations for this event.
RESOLVED Members, having considered the application made by Mr Ross together with his responses to their questions, the views of the objector and West Midlands Police, granted to Leisure and Lifestyle Events Ltd., The Gables, Llangathen, Carmarthenshire, SA32 8QD a Sexual Entertainment Venue (SEV), Sex Shop and Sex Cinema licence under the Local Government (Miscellaneous Provisions) Act 1982, subject to the following standard conditions for a Sexual Entertainment Venue:- STANDARD CONDITIONS (i) “The Council” shall mean Solihull Metropolitan Borough Council and all enquiries concerning these regulations and its conditions shall be directed to the Licensing Team , PO Box 1833, Council House, Solihull, West Midlands. B91 9DZ. (ii) These conditions apply to all premises licensed as a “sexual entertainment venue”, as defined by the 1982 Act and set out the terms, conditions and restrictions, on or subject to which, licences under Schedule 3 of the 1982 Act are in general to be granted, renewed, varied, or transferred. (iii) ”Sexual Entertainment Venue” (‘SEV’) means any premises at which relevant entertainment is provided, before a live audience, directly or indirectly for the financial gain of the organiser, or the entertainer. (iv) “Premises” includes any vessel, vehicle, or stall, but does not include any private dwelling, to which the public is not admitted. (v) ‘Relevant Entertainment’ means any live performance, or any live display of nudity, which is of such a nature, that ignoring financial gain, it must reasonably be assumed to be provided solely, or principally, for the purpose of sexually stimulating any member of the audience (whether by verbal or other means). (vi) The Council may at the time of granting, varying, or reviewing a licence, waive, modify, or vary these conditions, or impose additional special conditions, where considered reasonable, necessary and proportionate to do so, in any particular case. (vii) If the Licensee wishes any of the terms of the licence to be varied at any time, a written application to do so, must be made to the Council. (viii) In the event of a conflict between these prescribed conditions and any specific additional conditions, imposed by the Council on a SEV licence, those additional conditions shall prevail.
