ADOPTION OF HARM ASSESSMENT/PRIORITISATION SCHEME FOR PLANNING ENFORCEMENT pdf icon PDF 160 KB

To consider the adoption of a harm assessment system to be used in determining the expediency of pursuing cases where an initial investigation has identified a prima facie breach of planning control, by quantifying the degree of ‘planning’ harm caused. Also to agree consequential amendments to the Council’s adopted Local Enforcement Plan.

The Cabinet Portfolio Holder for Managed Growth approved the following:

 

(i)) The adoption of the Harm Assessment Form detailed at Appendix A of the report, subject to the amendments detailed below:

·  That a scoring threshold of 0-3 be applied to all assessment criteria on the Harm Assessment Form.

·  That the final sentence at the bottom of the first  page of the SMBC Harm Assessment Form ,”The trigger score may be varied according to work pressures” be removed from the document.

(ii) The granting of delegated authority to the Head of Development and Regulatory Management to make minor amendments as required by legislation to the amended version of the SMBC Harm Assessment Form and the Councils adopted Local Enforcement Plan.

(iii) That the amended version of the Harm Assessment Form be implemented as an integrated part of the existing case notes and reporting system used by the Councils Planning Enforcement team.

(iv) That a report be submitted to the Managed Growth Cabinet Portfolio Holder Decision Session in six months time detailing the use of the amended version of the Harm Assessment Form in terms of its impact on the Councils Planning Enforcement work.

APPLICATION FOR DESIGNATION OF A NEIGHBOURHOOD AREA BY DICKENS HEATH PARISH COUNCIL pdf icon PDF 179 KB

To consider the application made by Dickens Heath Parish Council and agree to designate the Parish as a Neighbourhood Area.

The Cabinet Portfolio Holder for Managed Growth granted delegated authority to the Director of Managed Growth following consultation with the Cabinet Portfolio Holder for Managed Growth to make the decision to designate the Neighbourhood Area as submitted by the Dickens Heath Parish Council.

The Cabinet Portfolio Holder for Managed Growth agreed that in accordance with Section 100A (4 ) of the Local Government Act 1972 ( as amended ) ,that the press and public be excluded from the Decision Session for the remainder of the business to be transacted, on the grounds that there would be disclosure to them of exempt information in terms of Paragraph 3 of Schedule 12 A of the above Act.
