A request to speak was received from Councillor Bob Grinsell and a deputation received and represented by Mr Ian Jamieson of St. Bernard’s Road, Olton, both in relation to Agenda Item 5 – St. Bernard’s Road, Olton Conservation Area Article 4 (1) Direction.

To consider the report of the Independent Examiner and agree the Council’s response to the recommendations.

Decision:

The purpose of the report was for the Cabinet Member for Climate Change, Planning and Housing to consider the report of the Independent Examiner and agree the Council’s response to the recommendations.

 

The Cabinet Member for Climate Change, Planning and Housing:

 

RESOLVED:

 

(a)  To agree the Council’s responses to the Examiner’s recommended modifications to the Berkswell Parish Neighbourhood Development Plan as set out in the Decision Statement at Appendix A of the report;

 

(b)  To agree that the Berkswell Parish Neighbourhood Development Plan be modified in accordance with the Decision Statement at Appendix A of the report and to proceed to referendum;

 

(c)  To accept the Examiner’s recommendation that it is not necessary to extend the referendum area and that the most appropriate area for the referendum is the Berkswell Parish Neighbourhood Area; and,

 

(d)  That subject to consultation with the Berkswell Parish Council, to avoid a referendum ballot taking place during the period of the school summer holidays (2019).

ST. BERNARD'S ROAD, OLTON CONSERVATION AREA ARTICLE 4 (1) DIRECTION pdf icon PDF 1 MB

Decision:

The purpose of the report was for the Cabinet Member for Climate Change, Planning and Housing to consider the making of an Article 4 (1) direction to remove permitted development rights from the properties within part of the Olton Conservation Area with immediate effect, in order to encourage alterations that preserve or enhance the area’s historic character.

 

The Cabinet Member for Climate Change, Planning and Housing:

 

RESOLVED:

 

(a)  To authorise the making of a direction under Article 4 (1) of the Town and Country Planning (General Permitted Development) (England) Order 2015 as amended, to remove permitted development rights from properties on and adjacent to St. Bernard’s Road within the Olton Conservation Area as per the amended plans circulated at the CPH Climate Change, Planning and Housing meeting dated 30th May 2019 (REV A);

 

(b)  To delegate authority to the Director for Managed Growth and Communities to serve all necessary notices in connection with the making and confirmation of the direction; and,

 

(c)  To delegate authority to the Director for Managed Growth and Communities to confirm the direction in consultation with the Cabinet Portfolio Holder and to inform the lead Opposition spokespersons of the decision once confirmed.
